Welcome to MakeIt (the “Site”), operated by MakeIt (“MakeIt,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Scope. These Terms apply only to the publicly available MakeIt website located at https://www.makeit.dev (and any successor domains) and any pages, newsletters, blog posts, or online forms that link to these Terms (collectively, the “Website”). They do not govern your use of the MakeIt application platform or any customer workspace hosted by MakeIt; such use is governed by separate agreements.

2. License & Site Access

If you submit any inquiries, feedback, ideas, or other materials through the Website (collectively, “Submissions”), you grant MakeIt a perpetual, irrevocable, worldwide, royalty‑free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Submissions for any lawful purpose. You are solely responsible for your Submissions and warrant that they do not infringe any third‑party rights.

5. Prohibited Conduct

You agree not to:

  • Use the Website in any manner that violates any applicable law or regulation;
  • Interfere with or disrupt the Website or servers/networks connected to the Website;

The Website may contain links to third‑party websites or services that are not owned or controlled by MakeIt. MakeIt is not responsible for the content or practices of those third parties. Access linked sites at your own risk.

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND TITLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MAKEIT’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50).

Some jurisdictions do not allow limitation of liability for personal injury or for certain damages; in such jurisdictions, the above limitations will apply to you only to the extent permitted by law.

We may update the Website and these Terms at any time. If we make material changes, we will post the updated Terms with a new “Last updated” date. Your continued use of the Website after the effective date constitutes acceptance of the revised Terms.

11. Governing Law & Venue

These Terms and your use of the Website are governed by the laws of the State of New York, without regard to conflict‑of‑law principles. Any legal action or proceeding arising out of or relating to the Website or these Terms must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in such courts.
